Puppy Sales Contract and Health Guarantee

1. Health Guarantee and Conditions
1.1 Health at Time of Pickup
- The puppy will be vaccinated (first shots) and dewormed.
- The puppy will be in good health and temperament.
- Buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours of pickup (excluding weekends/holidays).
1.2 Health Check and Replacement
- If the puppy is found to be in ill health by the licensed vet within 72 hours of pickup:
- The puppy must be returned to the breeder within 72 hours of the veterinarian visit.
- A written certificate of ill health from the vet must accompany the puppy.
- The breeder will replace the puppy or refund 50% of the original purchase price if no replacement is available.
1.3 Exclusions
- The breeder is NOT responsible for any vet bills, travel expenses, or other costs related to the puppy's care.
2. Genetic Testing and Health Guarantee
2.1 Completed Testing of Parents (unless otherwise noted)
- The puppy’s parents have been tested and cleared for:
- Embark DNA
- OFA Basic Cardiac
- OFA Thyroid
- OFA Hip and Elbow Dysplasia
2.2 Health Guarantee (Genetic Issues)
- The puppy is guaranteed against hereditary defects of the heart and eyes for 24 months.
- Exclusions: Conditions such as Addison’s disease, epilepsy, bloat, seizures, and cancer are not covered by this guarantee.
To claim under the guarantee, the buyer must provide the following:
- Proof of hereditary defects, diagnosed by a licensed specialist.
- Proof of spay/neuter.
- Certification that issues are genetic only (not caused by diet, accidents, etc.).
Due to new information and ongoing research, we no longer guarantee our puppies against hip/elbow dysplasia. Multiple environmental, situational and dietary factors have been proven to adversely affect the joint health of puppies/dogs.
2.3 Trupanion Insurance
- Each and every puppy in our program leaves here with a free Go Home Day offer for 30 free days of Trupanion pet insurance. While it is absolutely not required for you to maintain pet insurance, it is strongly recommended. There are several companies available if Trupanion is not right for you.
2.4 Microchipping
- Every puppy in our program leaves here microchipped with an ISO compliant microchip from FI Nano. My name and contact information will be a permanent part of your pet's microchip record. You are required to activate and register the microchip in your name within one week after picking up your puppy.
3. Conditions of Sale
3.1 Return Policy
- If the buyer cannot keep the puppy, the breeder must be contacted immediately, and the puppy must be returned in good health. No refund will be provided to the buyer, and the buyer will pay all shipping costs.
3.2 Care Requirements
- The puppy must always be provided with proper shelter, an annual vet checkup, and required vaccinations (including rabies).
- It is recommended that the buyer provides an appropriate WSAVA compliant diet to avoid serious health complications.
3.3 Transfer and Rehoming Restrictions
- The puppy cannot be given, sold, lent, or rehomed to anyone else (including breeders, shelters, etc.).
- The puppy must not be used for breeding or producing a litter at any time, either intentionally or unintentionally.
- Breeding results in forfeiture of the puppy, voiding the health guarantee, and a $15,000 monetary penalty.
3.4 Spay/Neuter Policy
- The puppy must be spayed/neutered between 18–24 months.
- The buyer must provide proof of spay/neuter by the age of 24 months to the breeder.
4. Additional Terms
4.1 Shipping Costs
- The buyer agrees to pay all shipping costs related to the puppy’s purchase and any potential return. This includes health certificates and crates or kennels as needed.
4.2 No Guarantees on Size or Color
- The breeder does not guarantee the puppy’s size, final color, temperament, or performance.
4.3 Death of Puppy
- In the event of the puppy’s death (natural or unnatural), the breeder must be notified immediately. The breeder reserves the right to request proof of the examination or necropsy by a veterinarian.
4.4 Ownership Transfer
- If the puppy is returned to the breeder, the registration paperwork must be signed over to the breeder, transferring ownership back to the breeder.
4.5 Deposit Policy
- A non-refundable deposit of $500 is required to reserve a puppy from a litter.
- If the sale does not proceed due to illness or death of the puppy, the deposit will be refunded in full.
- If the buyer changes their mind before the sale is completed, the deposit will not be refunded.
5. Legal Agreement
5.1 Entire Agreement
- This document constitutes the entire agreement between the buyer(s) and breeder. No verbal statements will be binding.
5.2 Jurisdiction
- Any disputes arising from this contract will be resolved in North Carolina courts.
